Sen. Francis Escudero vs. Atty. Jesus Falcis: Disbarment Case Sparks Heated Clash

Monday, Sept. 29, (Manila, Philippines) – Senator Francis Escudero filed a disbarment complaint against Atty. Jesus Nicardo Madarang Falcis III, before the Supreme Court. Escudero accused the latter of repeatedly posting defamatory, malicious, and insulting content on social media that allegedly violates the Code of Professional Responsibility and Accountability (CPRA).

 

Why Escudero Files a Complaint Against Falcis?

Senator Francis Escudero stated that he decided to file a complaint due to several Facebook posts made by Atty. Jesus Nicardo Madarang Falcis III. In the posts, Falcis allegedly called him a liar, “rotten cheese,” and the “worst Senate President in history.” He also accused Escudero of getting money from budget insertions and flood control projects.

Escudero claimed these statements were false, damaging to his reputation, and a violation of the CPRA. This rule requires lawyers to maintain respect and professionalism, even in public comments.

Atty. Falcis defended himself against the disbarment case, saying his Facebook posts were fair criticisms of Senator Francis Escudero’s performance as a public official. He argued that instead of filing cases, Escudero should answer the issues raised about his record.

 

Falcis also pointed out that the senator publicly revealed the complaint, which he said violated Supreme Court rules requiring confidentiality in disciplinary cases against lawyers. He claimed that this action could even be grounds for a sanction.

 

The lawyer maintained that his statements are part of free expression, stressing that questions about budget insertions and government integrity are issues of public concern. He added that Escudero reacts to his words only because, in his view, “they ring true.”

 

Falcis has been outspoken about government officials and their move. He utilized social media platforms to air strong opinions on issues of corruption, accountability, and public service. The clash with Senator Escudero is the latest in a series of controversies that highlight the tension between free speech and the professional limits set for members of the legal profession. The Supreme Court will now determine if his online remarks warrant disciplinary action.
